Although you can get your hands on the latest copy of the labor code by visiting your nearest bookstore or going online, many HR personnel still get confused. This is probably because of the technical terms used in the code as well as varying practices of the different companies coupled with &#8220;hear says&#8221; from people who are not really into HR.</p>
<p>Here are some of the most common HR mistakes that take place in the corporate world:</p>
<ol>
<li><strong>Outright firing of employees because the code of conduct calls for a termination for the violation involved</strong>. Make sure that before you terminate someone, or even suspend someone, you have given the employee a notice to explain indicating what his violation is/ are and what are the consequences. He should also be given ample time (some companies go for 48 hours, others 72 hours) to explain his side and give reason why he should not be penalized before you give him the Notice of Decision (NOD). The NOD should indicate the result of your investigation, the penalty, and when it would take effect (in the case of termination or suspension).</li>
<li><strong>Not having any code of conduct in place</strong>. Your code of conduct would clearly define what is and what is not allowed within your company premises. It would also give the employees an idea on what the penalties are and how the discipline system works in your company. oftentimes, the code of conduct comes as a part of the employee handbook and is discussed with them during their first day of work.</li>
<li><strong>No paternity leave policy or solo parent program in place</strong>. Paternity Leave and the Solo Parent leave are two leave benefits that are oftentimes being forgotten by most HR newbies. Paternity Leave can be availed of by married male employees who are cohabiting with their spouse who is about to give birth or has just recently given birth. He can only claim for this benefit for the first four (4) deliveries. <li><strong>No Drug-Free Program in place</strong>. All private companies employing more than 10 people are required to have a drug-free program in place. This includes setting guidelines on prevention and control of drug use. <li><strong>Terminating based on illness</strong>. Before you can have someone terminated for illness, you have to check first whether the illness can be cured within six (6) months and whether the employee&#8217;s continuous employment poses a threat to his health as well as to the health of his co-employees.</li>
